Details of consumer court and on how to file consumer complain

Every one of us are victim as every one is a consumer. This Blog is to create awareness in  public about consumer cases on how to put complaint and where to. I have tried to include each and every minute but useful details but I may miss some, so all your comments are welcome. As I will be getting more information, I will update on the blog.

Consumer complaint can be filed for any product or service taken after paying to merchant, establishment, insurance company, credit card company etc. When we think of filing consumer complaint,  following questions come to our mind:

             1.  How to file complaint?
              2. Where  to file complaint?
              3. What should be the content of complaint?
              4. Is there any fee, needs to give for consumer complaint?
              5. How to pay the court fee?
              6. Do we need to hire a lawyer for this?
              7. Blah blah....

When we do not get the proper details, answers to our questions we drop our plan to file complain.
And culprits enjoys thinking nobody can do any harm to them. Below is answers to all questions except for question number 07. As even I dont know the answer ;). For Now I have dumped all the information on this blog but I will be arranging the content.

Internet is full of personal websites in the name of "consumer court/forum".But none of the website gives guarantee to solve the issue as none of them is authorised to do so.These false websites make money in the name of "consumer court/forum".  In actual there is no consumer forum or court. It is "Consumer Disputes Redressal Forum" establisd by government which is in short called "consumer court/forum".  If you are putting your complaint on any website then you are wasting your time. However some companies responds on these website complaints to save their brand name. But they are not bounded to do so. So beware of posting your case on internet.
If you want to search  for details of "consumer court", google about "Consumer Disputes Redressal Forum".
You will get legitimate results. :)

Actual courts:

Based on the amount of transaction, Complaint can be made to three type of courts:

1. District Consumer Disputes Redressal Forum: If  amount of transaction is less than 20lac. court fee is Rs. 100 should be paid with the application in the form of Demand Draft. 

2. State Consumer Disputes Redressal Commission if the transaction amount and compensation is more than Rs.20 Lacs but less than Rs.1 Crore. Court Fee of Rs.2000 (if transaction / relief is less than Rs.50 Lacs) or Rs.4000 (if transaction / relief is more than Rs.50 Lacs) should be paid with the application in the form of Demand Draft in the name of Registrar, State Consumer Disputes Redressal Commission, Karnataka.

3. National Consumer Disputes Redressal Commission (NCDRC):  if the value of goods or transaction amout and compensation is more than Rs.1 Crore. Court Fee of Rs.5000 should be paid with the application in the form of Demand Draft in the name of The Registrar, NCDRC, New Delhi.


Note :

1.  Working hours of the court is 10AM to 5PM.
2.  First hearing will be after 1 month of submitting the complaint.
3.  Subsequent hearing will be within weeks. Generally it is settled within 2-3 hearings.
4.  Subsequent hearing may be at different locations.These hearings will be in the same city

I had filed a case against "Reliance Communication Ltd" in consumer court. Case was against the false advertisement/marketing/selling of their broadband internet services at the speed of 3.1 mbps (the speed they claimed in their product). Called multiple times their customer care number, pissed off from their monotonous answer "Your usage area is under congestion".

Finally verdict came in favour of me. Court has asked Reliance to pay me for poor service and false promise/advertisement. You can also file a case against any company/firm for poor quality of product/services or false advertisement. It is very easy to file a complain in consumer court. Jago Grahak Jago !!!"

    1. Location will be in the same city. For Bangalore complaint filing con only be done @ "B’lore Urban DCDRF., Cauvery Bhavan,8th Floor,BWSSB Wing,KG.Road,Bangalore" but hearing can be at sheshadripuram.
